PROPERTY LAW ACT 1974 - SECT 71A

71A Application of div 4

(1) This division shall not bind the Crown.

(2) Where a contract for the sale of land may, at the election of the purchaser, be performed in a manner which would constitute it an instalment contract, it shall, unless and until the purchaser elects to perform it in some other manner, be presumed to be an instalment contract within the meaning of this section.

(3) This division applies—

(a) to an instalment contract entered into after the commencement of this Act; and

(b) despite anything to the contrary contained in any contract.

(4) Sections 74 to 76 do not apply with respect to a contract for the sale of land by the public trustee.
