PROPERTY OCCUPATIONS ACT 2014 - SECT 33
Requirement to give information or material about application or request
33 Requirement to give information or material about application or request
(1) This section applies to each of the following— (a) an applicant for a
licence;
(b) an applicant for renewal of a licence;
(c) an applicant for
restoration of a licence;
(d) an applicant for the appointment or extension
of the appointment of a nominated person mentioned in section 66 (3) or 67 (4)
as a licensee’s substitute licensee;
(e) a licensee who has asked the chief
executive to reactivate the licensee’s licence.
(2) The chief executive
may, by written notice given to the applicant, require the applicant to give
the chief executive within a stated reasonable period information or material
the chief executive reasonably considers is needed to decide the application
or request. Example of that information or material— information or
material the chief executive reasonably considers is needed to establish the
applicant’s or licensee’s suitability for the licence
(3) The applicant
or licensee is taken to have withdrawn the application or request if, within
the stated reasonable period, the applicant or licensee fails to comply with
the chief executive’s requirement.
