(1) This section applies if a missing person warrant is issued in relation to a place.
(2) The occupier of the place may apply to the Supreme Court judge or magistrate that issued the missing person warrant for an order revoking the warrant if the application for the warrant was made in the absence of the occupier and the occupier—(a) did not know about the application; or(b) had a genuine reason for not being present during the hearing of the application.
(3) The judge or magistrate may revoke or refuse to revoke the warrant.
(4) The making of an application under subsection (2) , or an application under the Judicial Review Act 1991 for review of the decision to issue the missing person warrant, does not stay the effect of the warrant.
