(1) The judge must hear the application for approval of the exercise of powers under the emergency authorisation in the absence of anyone other than the following—(a) the applicant;(b) a monitor;(c) someone the judge permits to be present;(d) a lawyer representing anyone mentioned in paragraphs (a) to (c) .
(2) Also, the judge must hear the application—(a) in the absence of the person placed under or proposed to be placed under surveillance (the
"relevant person" ) or anyone likely to inform the relevant person of the application; and(b) without the relevant person having been informed of the application.
