(1) This section applies if—(a) the relevant court is satisfied impounding or forfeiting a motor vehicle will cause severe financial hardship to an owner or usual driver of the motor vehicle; and(b) the person to whom the application relates was an adult when the person committed the offence, or the last offence, to which the application relates.
(2) The court may, instead of ordering the impounding or forfeiture of the motor vehicle, order the person to perform not more than 240 hours community service.
(3) An order made under subsection (2) —(a) is taken to be an order under the Penalties and Sentences Act 1992 for the performance of community service under a fine option order under that Act; and(b) is taken to have been made in the proceeding for the evasion offence giving rise to the application for the impounding order or forfeiture order.
