PUBLIC SERVICE ACT 2008 - SECT 100
Extent of chief executive’s autonomy
(1) A chief executive is subject to the directions of the departmental
Minister in managing the department, other than to the extent— (a) the
chief executive is making decisions about particular individuals; or
(b)
another Act— (i) provides that the chief executive is not subject to the
directions of the departmental Minister about particular matters; or
(ii)
limits the extent to which, or circumstances in which, the chief executive is
subject to directions of the departmental Minister.
(2) In making decisions
about particular individuals, the chief executive— (a) is subject to any
direction given by the commission in a report about a procedural aspect of a
current work performance matter under section 88IA ; and
(b) must otherwise
act independently, impartially and fairly; and
(c) is not subject to
direction by a Minister.
