PUBLIC SERVICE ACT 2008 - SECT 153
Failure to consent to obtaining criminal history
153 Failure to consent to obtaining criminal history
(1) This section applies if the person does not consent, or withdraws his or
her consent, to the chief executive obtaining the person’s criminal history.
(2) If the person is a public service employee in the department who is
engaged in performing relevant duties, the chief executive must ensure the
person does not perform relevant duties.
(3) If the person is not a
public service employee in the department who is engaged in performing
relevant duties, the chief executive is not required to consider the person
for engagement to perform the relevant duties.
