218A Commission chief executive must make directive about dealing with
individual employee grievances
(1) The commission chief executive must make a directive (the
"individual employee grievances directive" ) about how departments must deal
with grievances of officers or employees of the department about— (a)
decisions made by officers or employees of the department; or
(b) the conduct
of officers or employees of the department.
(2) Without limiting subsection
(1) , a directive made under this section— (a) must provide for— (i) the
procedures for dealing with grievances mentioned in subsection (1) ; and
(ii)
the period within which the grievances must be finally dealt with; and
(iii)
the notification of decisions made in dealing with the grievances; and
(b)
must provide that, if a person required to deal with a grievance about a
decision mentioned in subsection (1) (a) fails to finally deal with the
grievance within the period mentioned in paragraph (a) (ii) , the person is
taken to have confirmed the decision at the end of that period; and
(c) may
apply to a decision mentioned in section 194 ; and
(d) may provide for a
system for dealing with grievances that involves— (i) a person dealing with
a grievance in the first instance; and
(ii) another person dealing with
(including, for example, by way of review) decisions made by the person who
dealt with the grievance in the first instance.
