Disclosure of interests
65 Disclosure of interests
(1) This section applies if— (a) the chairperson has an interest in a matter
being considered, or about to be considered, by the commission at a commission
meeting; and
(b) the interest could conflict with the proper performance of
the chairperson’s functions for the matter.
(2) The chairperson must, as
soon as practicable, disclose the interest to the commission chief executive.
(3) Unless the commission otherwise decides, the chairperson must not
participate in the commission’s consideration of the matter at the meeting.
(4) A reference to an interest or to a conflict of interest is a reference to
those matters within their ordinary meaning under the general law, and, in
relation to an interest, the definition in the Acts Interpretation Act 1954 ,
schedule 1 , does not apply.
