67 Criminal history checks to confirm suitability for appointment
(1) To help decide whether a person is suitable for nomination for appointment
as the commission chief executive or the chairperson, the Minister may ask the
police commissioner for a report about the person’s criminal history.
(2)
However, the Minister may make the request only if the person has given the
Minister written consent for the request.
(3) The police commissioner must
comply with the request.
(4) However, subsection (3) applies only to
information in the police commissioner’s possession or to which the
commissioner has access.
(5) If the criminal history of the person includes a
conviction recorded against the person, the commissioner’s report must be
written.
(6) The Minister must destroy the report as soon as practicable
after the decision has been made.
