PUBLIC SERVICE ACT 2008 - SECT 94
Acting as chief executive
(1) The departmental Minister for a department may appoint a person to act as
its chief executive during any period or all periods when— (a) no-one is
employed as chief executive; or
(b) the chief executive is absent from duty
or is, for another reason, unable to perform the responsibilities of
chief executive.
(2) It does not matter whether the appointee is or is not
already a public service officer.
