How property may be dealt with
106N How property may be dealt with
(1) This section applies if, under section 106M , a place, part of a place,
building or other structure or other thing becomes the property of the State.
(2) The commissioner may deal with the place, part of the place, building,
structure or thing as the commissioner considers appropriate, including, for
example, by destroying it or giving it away.
(3) The commissioner must not
deal with the place, part of the place, building, structure or thing in a way
that could prejudice the outcome of an appeal against the forfeiture under
this part.
(4) If the commissioner sells the place, part of the place,
building, structure or thing, the commissioner may, after deducting the costs
of the sale, return the proceeds of the sale to the former owner of the place,
part of the place, building, structure or thing.
