Prosecutions for offences
111 Prosecutions for offences
(1) A prosecution for an offence against this Act may be started within 3
years after the alleged date of commission of the offence or within 2 years
after the offence comes to the knowledge of the commission, whichever is the
later.
(2) A prosecution may only be started by a person authorised by the
commission, or the Attorney-General, (either generally or in the particular
case) to bring the prosecution.
(2A) However, the commission must not bring a
prosecution for an offence against this Act that is a crime.
(3) The
authorisation required by subsection (2) is to be presumed in the absence of
evidence to the contrary.
(4) Subsection (1) does not limit the
State Penalties Enforcement Act 1999 , section 32 .
