QUEENSLAND BUILDING AND CONSTRUCTION COMMISSION ACT 1991 - SECT 47
Warnings
47 Warnings
(1) If— (a) building work is carried out on land by a person who is not
licensed to carry out that building work; and
(b) the land is offered for
sale within 6 years after completion of the building work;
the vendor must,
before the contract of sale is signed by the purchaser, give the prospective
purchaser a notice containing details of the building work and a warning in
the form required by regulation.
(2) If a notice is not given as required by
this section, the vendor will be taken to have given the purchaser a
contractual warranty (which operates to the exclusion of any inconsistent
provision of the contract of sale) that the building work was properly carried
out.
