QUEENSLAND BUILDING AND CONSTRUCTION COMMISSION ACT 1991 - SECT 68I
Commencement of cover
68I Commencement of cover
(1) For residential construction work carried out under a contract with a
consumer (other than work that is the subject of a construction management
contract), cover under the statutory insurance scheme for the work comes into
force on the earliest of the following to happen— (a) a licensed contractor
pays the appropriate insurance premium for the work under section 68B (2) ;
(b) the consumer enters into the contract with a licensed contractor for the
carrying out of the work;
(c) a licensed contractor starts carrying out the
work.
(2) For speculative residential construction work, cover under the
statutory insurance scheme for the work comes into force on the earlier of the
following to happen— (a) the licensed contractor who is to carry out the
work pays the appropriate insurance premium for the work under section 68B (3)
;
(b) the contractor starts carrying out the work.
(3) For residential
construction work managed by a construction manager under a construction
management contract, cover under the statutory insurance scheme for the work
comes into force on the earlier of the following to happen— (a) the
construction manager pays the appropriate insurance premium for the work under
section 68C (2) ;
(b) a licensed contractor starts carrying out the work.
(4) Optional additional cover comes into force when the appropriate insurance
premium for the relevant residential construction work is paid under
section 67Z (3) .
