QUEENSLAND BUILDING AND CONSTRUCTION COMMISSION ACT 1991 - SECT 70B
Optional additional cover
70B Optional additional cover
(1) This section applies if— (a) a consumer for a contract for the carrying
out of residential construction work obtained optional additional cover for
the work; and
(b) the residential construction work is to be varied after the
consumer obtained the optional additional cover; and
(c) the commission is
satisfied that the value of the residential construction work will change
because of the variation.
(2) If the value of the residential construction
work will increase by $5,000 or more because of the variation, the consumer
must pay the additional insurance premium for the work to the commission
before any work relating to the variation starts.
(3) If the value of the
residential construction work will decrease because of the variation, the
commission may refund part of the insurance premium paid for the work to the
consumer.
(4) If the consumer fails to pay the additional insurance premium
under subsection (2) , the commission may recover the amount of the premium,
as a debt, from the consumer.
