Constitution generally
165 Constitution generally
(1) The president must choose 1, 2 or 3 members, or an adjudicator, to
constitute the tribunal for a particular matter.
(2) The person or persons
chosen by the president under subsection (1) constitute, and may exercise all
the jurisdiction and powers of, the tribunal in relation to the matter.
(3)
For an appeal, or a proceeding relating to an application for leave to appeal
to the appeal tribunal, a reference in this Act to the tribunal includes a
reference to the appeal tribunal constituted, or to be constituted, for the
appeal or proceeding.
(4) Subsection (3) does not limit another reference in
this Act to the tribunal being taken to include a reference to the tribunal as
constituted by the appeal tribunal, if the context requires or permits.
