RESIDENTIAL TENANCIES AND ROOMING ACCOMMODATION ACT 2008 - SECT 117
Duty to pay rental bond instalments under residential tenancy agreement
(1) This section applies to a lessor who— (a) receives financial or other
assistance from the State to supply rented accommodation to persons; and
(b)
enters into a residential tenancy agreement using the assistance; and
(c)
receives from the tenant a number of rental bonds for the agreement (the
"rental bond instalments" ).
(2) If the lessor or lessor’s agent has
received all the rental bond instalments, the lessor or agent must, within 10
days after receiving the last instalment— (a) pay the instalments to the
authority; and
(b) give the authority a notice, in the approved form, about
the instalments.
Penalty— Maximum penalty—40 penalty units.
(3)
If the agreement ends before the lessor or agent receives all the
rental bond instalments, the lessor or agent must, within 10 days after the
ending of the agreement— (a) pay the instalments received by the lessor or
agent to the authority; and
(b) give the authority a notice, in the approved
form, about the instalments.
Penalty— Maximum penalty—40 penalty
units.
