RESIDENTIAL TENANCIES AND ROOMING ACCOMMODATION ACT 2008 - SECT 216
Nominated repairer for emergency repairs
(1) The lessor must nominate a person (the
"nominated repairer" )— (a) to act for the lessor in arranging for emergency
repairs, or emergency repairs of a particular type, to be made of the premises
or inclusions; or
(b) to make emergency repairs, or emergency repairs of a
particular type, of the premises or inclusions for the lessor.
(2) The
nominated repairer must be stated in the residential tenancy agreement or a
written notice given by the lessor to the tenant.
(3) The
residential tenancy agreement or notice must state— (a) the name and
telephone number of the nominated repairer; and
(b) whether or not the
nominated repairer is the tenant’s first point of contact for notifying the
need for emergency repairs.
(4) The lessor must give written notice to the
tenant of any change of the lessor’s nominated repairer or the telephone
number of the nominated repairer.
(5) This section does not apply if— (a)
the lessor has given the tenant a telephone number of the lessor; and
(b)
under the residential tenancy agreement, the lessor is to arrange for
emergency repairs to be made to the premises or inclusions.
