Rules made by the provider
268 Rules made by the provider
(1) A provider may make house rules for rental premises about any of the
following matters— (a) using shared facilities;
(b) parking motor vehicles;
(c) drinking alcohol or illegally consuming other drugs;
(d) smoking;
(e)
making noise;
(f) keeping pets;
(g) guests;
(h) another matter prescribed
under a regulation.
(2) A rule made under subsection (1) has effect as a
house rule for the rental premises only if— (a) it is consistent with— (i)
the prescribed rules; and
(ii) the provider’s obligations and the
resident’s rights under this Act; and
(b) the rule is made under division 2
.
(3) Subsection (2) (b) does not apply to the making of a rule when there
are no residents for the rental premises.
(4) A provider must not make a rule
about a matter not provided for under subsection (1) . Penalty— Maximum
penalty for subsection (4) —20 penalty units.
