Offer or payment of rent does not operate as waiver of lessor’s breach
279 Offer or payment of rent does not operate as waiver of lessor’s breach
If the tenant pays or offers to pay to the lessor rent payable under the
agreement, the payment or offer does not operate as a waiver of—
(a) a
breach of the agreement by the lessor; or
(b) a notice of intention to leave
for an unremedied breach given to the lessor by the tenant.
