RESIDENTIAL TENANCIES AND ROOMING ACCOMMODATION ACT 2008 - SECT 294
Application for termination for failure to leave as intended
(1) The lessor may apply to a tribunal for a termination order because the
tenant— (a) gave a notice of intention to leave the premises to the lessor;
and
(b) did not withdraw the notice before the handover day; and
(c) failed
to hand over vacant possession of the premises to the lessor on the handover
day.
(2) An application under this section must be made within 2 weeks after
the handover day.
(3) An application under this section is called an
application made because of a
"failure to leave as intended" . Note— See sections 335 (1) and 342 for
other provisions about the application.
