Dispute about abandonment termination notice
356 Dispute about abandonment termination notice
(1) If the tenant disputes an abandonment termination notice, the tenant may
apply to a tribunal for an order— (a) setting aside the notice; or
(b) for
compensation.
(2) The application must be made within 28 days after the
notice is given.
(3) On an application under this section, the tribunal
may— (a) if the application was made within 7 days after the notice was
given—make an order setting aside the notice; or
(b) if paragraph (a) does
not apply—make any of the following orders— (i) an order terminating the
agreement;
(ii) an order requiring the lessor to pay to the tenant the amount
stated by the tribunal as compensation for loss or expense incurred by the
tenant because of the termination of the agreement;
(iii) any other order it
considers appropriate.
