RESIDENTIAL TENANCIES AND ROOMING ACCOMMODATION ACT 2008 - SECT 397

397 Application of pt 1

(1) This part applies if there is an issue in dispute relating to a residential tenancy agreement (a
"tenancy dispute" ) and the lessor and tenant have been unable to resolve the dispute through negotiation.

(2) This part also applies if there is an issue in dispute relating to a rooming accommodation agreement (a
"rooming accommodation dispute" ) and the provider and resident have been unable to resolve the dispute—

(a) through negotiation; or

(b) if there is a dispute resolution process operating for the rooming accommodation, by using that process.
