Particular applications to be heard in private
433A Particular applications to be heard in private
(1) A proceeding before the tribunal about an application made to the tribunal
must be held in private if— (a) the application is made under section 245 or
321 ; or
(b) the application is made under section 312 and the applicant is
the domestic associate of the other cotenant or another cotenant; or
(c) the
application is made under section 323 and the applicant is the
domestic associate of the tenant.
(2) In this section—
"domestic associate" means a person in any of the following relationships—
(a) an intimate personal relationship;
(b) a family relationship;
(c) an
informal care relationship.
(3) A term used in subsection (2) (a) to (c) has
the same meaning as in the Domestic and Family Violence Protection Act 2012
and a reference in that Act to a court deciding whether a relationship exists
includes a reference to the tribunal deciding that issue for this section.
