Notices given, and proceedings started, by the State
554 Notices given, and proceedings started, by the State
(1) This section applies if— (a) the State gives a tenant a notice or starts
a proceeding under this Act in relation to an existing State tenancy
agreement; and
(b) the existing State tenancy agreement is terminated under
section 527C(2)(a); and
(c) at the time the existing State tenancy agreement
is terminated, an action is pending under the notice or proceeding.
(2) The
replacement lessor— (a) is taken to have given the notice or started the
proceeding; and
(b) may continue action under this Act against the tenant in
relation to the notice or proceeding in place of the State.
(3) The action
continues in relation to the existing State tenancy agreement despite its
termination under section 527C(2)(a).
