Effect on relationships
39 Effect on relationships
(1) This section applies if the court makes a parentage order in relation to a
child in favour of an intended parent, or intended parents.
(2) On the making
of the parentage order— (a) the child becomes a child of the
intended parent, or intended parents, and the intended parent, or
intended parents, become the parent, or parents, of the child; and
(b) the
child stops being a child of a birth parent and a birth parent stops being a
parent of the child.
(3) Other relationships are determined in accordance
with subsection (2) .
(4) However, for the purpose of applying a law relating
to a sexual offence where a familial relationship is relevant, the child is
taken to have both the familial relationships that existed before the making
of the parentage order as well as the familial relationships that result from
the making of the parentage order.
