TRANSPORT OPERATIONS (MARINE POLLUTION) ACT 1995 - SECT 110
Compensation
110 Compensation
(1) A person may claim compensation from the State if the person incurs loss
or expense because of the exercise or purported exercise of a power under this
part, including, for example, in complying with a requirement made of the
person under this part.
(2) Payment of compensation from the State may be
claimed and ordered— (a) in a proceeding brought in a court with
jurisdiction for the recovery of compensation; or
(b) in a proceeding for an
offence against this Act brought against the person making the claim for
compensation.
(3) A court may order the payment of compensation for the loss
or expense only if it is satisfied it is just to make the order in the
circumstances of the particular case.
(4) A regulation may prescribe matters
that may, or must, be taken into account by the court when considering whether
it is just to make the order.
