Notice to be given of suspension or disqualification
79D Notice to be given of suspension or disqualification
(1) This section applies if, under section 79B — (a) a person’s Queensland
driver licence, or authority to drive on a Queensland road under a
non-Queensland driver licence, is suspended; or
(b) a person is disqualified
from obtaining or holding a Queensland driver licence.
(2) As soon as
practicable after the person is charged with the offence to which the
suspension or disqualification relates— (a) a police officer must give the
person a notice about the suspension or disqualification, in the approved
form, for the person’s information; and
(b) the commissioner must give the
chief executive notice about the details of the suspension or
disqualification.
(3) Failure by a police officer or the commissioner to give
notice under subsection (2) (a) or (b) about the suspension or
disqualification does not invalidate the suspension or disqualification, or
affect anything done in relation to the suspension or disqualification unless,
in relation to a notice under subsection (2) (a) , the police officer has no
reasonable excuse for failing to give the notice.
