36 Chief executive may obtain information from police commissioner—criminal
history
(1) The chief executive may ask the police commissioner for a written report
about a person’s criminal history, including whether the person is, or has
been, the subject of a control order or registered corresponding control
order, to help in deciding whether— (a) the person is an appropriate person
to hold, or continue to hold, a licence or certificate under this Act; or
(b)
a corporation of which the person is an executive officer is an appropriate
person to hold, or continue to hold, a licence under this Act.
(2) For
subsection (1) , the chief executive’s request may include the following
information— (a) the person’s name and any other name the chief executive
believes the person may use or may have used;
(b) the person’s sex and date
and place of birth;
(c) details of the person’s driver licence under the
Transport Operations (Road Use Management) Act 1995 ;
(d) details of the
person’s licence or certificate under this Act.
(3) If asked by the chief
executive, the police commissioner must give the chief executive a written
report about the person’s criminal history.
(4) Subsection (3) applies to
the criminal history in the police commissioner’s possession or to which the
police commissioner has access.
(5) A report under subsection (3) must, if
the person is, or has been, the subject of a control order or registered
corresponding control order— (a) state the details of the order; or
(b) be
accompanied by a copy of the order.
