Offences generally and penalty
40 Offences generally and penalty
(1) A person who contravenes or fails to comply with any provision of this Act
commits an offence against this Act.
(2) If the holder of a licence
contravenes a condition of the licence mentioned in section 12 (2) (a) to (d)
, the holder commits an offence against this Act. Penalty— Maximum
penalty—50 penalty units.
(3) If a person contravenes a condition of the
licence mentioned in section 12 (2) (e) to (t) , the person and, if the person
is not the holder of the licence, the holder, commits an offence against this
Act. Penalty— Maximum penalty—50 penalty units.
(4) Save where a
specific penalty is otherwise prescribed a person who commits an offence
against this Act is liable to a penalty of 40 penalty units.
(5) A penalty
imposed by this Act may be recovered by way of summary proceedings before a
Magistrates Court constituted under the Justices Act 1886 .
(6) A court
before which a person is convicted of an offence against this Act shall cause
particulars of the conviction to be furnished to the chief executive.
