VICTIMS OF CRIME ASSISTANCE ACT 2009 - SECT 174
Deciding component of assistance after reduction under s 172 or 173
174 Deciding component of assistance after reduction under s 172 or 173
(1) This section applies if, in relation to a single act of violence— (a)
the victim assistance payable to the person is reduced under section 172(2) or
173(2)(b), or both of those provisions; and
(b) an amount of victim
assistance remains payable to the person after the reduction.
(2) The
government assessor must— (a) decide the component of victim assistance for
which the amount is payable, having regard to— (i) the person’s needs; and
(ii) whether the person has incurred any expenses; and
(iii) anything else
the government assessor considers relevant; and
(b) give the person a notice
stating— (i) the decision; and
(ii) the reasons for the decision; and
