Obtaining information about prosecution
67 Obtaining information about prosecution
(1) The government assessor may ask the director of public prosecutions for
the following information about a stated act of violence in relation to which
assistance is sought— (a) details of the charges laid for the
act of violence, including any charge laid against a person for conspiring
with the person who committed the act;
(b) details of the place and date of
hearing of the proceeding for the charge;
(c) a decision to substantially
change the charge, or not to continue with the charge, or to accept a plea of
guilty to a lesser charge;
(d) the outcome of a proceeding for the charge,
including any sentence imposed and the outcome of any appeal.
(2) The
director must comply with the request if the director is reasonably satisfied
the government assessor reasonably requires the information to decide the
application.
(3) The giving of information by the director under subsection
(2) is authorised despite any other Act or law, including a law imposing an
obligation to maintain confidentiality about the information. Note— See
section 140 for restrictions on disclosing or giving access to information or
documents obtained under this Act.
