WORKERS' COMPENSATION AND REHABILITATION ACT 2003 - SECT 105B
Non-scheme employer continues to be self-insurer for 12 months
105B Non-scheme employer continues to be self-insurer for 12 months
(1) The non-scheme employer is taken to continue to be a self-insurer for 12
months from the exit date for the purposes of the injuries mentioned in
subsection (3) .
(2) For subsection (1) , the self-insurer’s licence of the
non-scheme employer (the
"continued licence" ) continues until it is cancelled under section 105E .
(3) The non-scheme employer is liable for compensation and damages for the
total of the accrued, continuing, future and contingent liabilities for all
injuries sustained by a worker employed by the non-scheme employer that arise
from an event happening or ending during the period the non-scheme employer
was licensed as a self-insurer but before the exit date.
(4) The non-scheme
employer continues to have the functions and powers of a self-insurer under
section 92 or 92A for the injuries mentioned in subsection (3) for the period
of 12 months after the exit date.
