(1) This part applies if a worker dies because of an injury.
(2) However, this part does not apply if—(a) a worker dies because of a latent onset injury that is a terminal condition; and(b) the worker had received a payment of lump sum compensation or damages for the latent onset injury under this Act, another Act or a law of another State or the Commonwealth.
(3) The object of this part is to provide for payment by an insurer of—(a) particular expenses arising from the worker’s injury and death; and(b) compensation to persons having an entitlement to compensation under this part.
