WORKERS' COMPENSATION AND REHABILITATION ACT 2003 - SECT 49
Exemption if employer has other insurance
49 Exemption if employer has other insurance
(1) WorkCover may exempt an employer from insuring under this Act if WorkCover
is satisfied that the employer has similar insurance for the employer’s
workers under another law.
(2) To exempt an employer, WorkCover must— (a)
be satisfied that the employer’s workers will not be disadvantaged; and
(b)
obtain advice from the Regulator that the exemption will not adversely affect
the workers’ compensation scheme.
(3) If an employer is aggrieved by
WorkCover’s decision, the employer may have the decision reviewed under
chapter 13 .
