(1) This section applies if an authorised person is intending to enter a place under a search warrant issued under this subdivision.
(2) Before executing a search warrant, the authorised person named in the warrant or an assistant to the authorised person must do or make a reasonable attempt to do the following things—(a) identify themself to a person who is an occupier of the place and is present by producing the authorised person’s identity card or another document evidencing the authorised person’s appointment;(b) give the person a copy of the warrant;(c) tell the person the authorised officer is authorised by the warrant to enter the place;(d) give any person at the place an opportunity to allow the authorised person immediate entry without using force.
(3) However, the authorised person or an assistant to the authorised person is not required to comply with subsection (1) if the authorised person or assistant reasonably believes that immediate entry to the place is needed to ensure—(a) the safety of any person; or(b) that the effective execution of the search warrant is not frustrated.
