Lack of jurisdiction discovered in course of a proceeding
130 Lack of jurisdiction discovered in course of a proceeding
(1) This section applies if, in the course of a proceeding, a court finds that
it does not have jurisdiction to hear and determine the proceeding because of
this Act.
(2) If the court has the necessary jurisdiction in its concurrent
jurisdiction, it may continue the proceeding in the concurrent jurisdiction.
(3) If the court does not act under subsection (2) , it may deal with the
proceeding under section 129 .
