Reasons for decisions to keep or remand children in custody
48B Reasons for decisions to keep or remand children in custody
(1) If a court makes an order keeping or remanding a child in custody in
connection with a charge of an offence, the order must state the reasons for
the decision.
(2) If a police officer decides to keep a child in custody in
connection with a charge of an offence, the police officer must make a record
of the reasons for the decision.
(3) The keeping or remanding of a child in
custody is not unlawful merely because a court or police officer does not
comply with subsection (1) or (2) .
(4) Subsection (1) is subject to the
Bail Act 1980 , section 12 .
