Application of usual laws where necessary
66 Application of usual laws where necessary
(1) Subject to subsections (2) and (3) , for the purposes of the powers and
jurisdiction of a Childrens Court conferred by this Act, the provisions of the
Criminal Code , Justices Act 1886 and other Acts apply to— (a) the
institution and conduct of a proceeding before a Childrens Court; and
(b) the
exercise by a Childrens Court of its powers and jurisdiction; and
(c) the
enforcement of an order made by a Childrens Court.
(2) Provisions applied
under subsection (1) apply, with all necessary modifications and any
prescribed modifications— (a) in relation to a Childrens Court judge in the
way they apply in relation to the District Court; and
(b) in relation to a
Childrens Court magistrate in the way they apply in relation to a Magistrates
Court.
(3) To the extent that another provision of this Act is inconsistent
with a provision applied under subsection (1) , the other provision of this
Act prevails.
