Building certifier’s obligation to keep record of decision
36 Building certifier’s obligation to keep record of decision
(1) If, under this part, a building certifier decides an individual is a
competent person, the certifier must keep a record stating the following
matters— (a) the competent person’s name;
(b) the matters for which the
person was decided to be a competent person;
(c) the day the decision was
made;
(d) if, under section 34 (4) , the certifier decided the individual has
been a competent person (design-specification) from a particular day that was
before the day the decision was made—the particular day;
(e) details of the
documents or information relied on by the certifier to make the decision;
(f)
the certifier’s reasons for the decision.
Penalty— Maximum
penalty—20 penalty units.
(2) The certifier must keep the record for
least 7 years from the day the decision was made. Penalty— Maximum
penalty—20 penalty units.
