CIVIL PROCEEDINGS REGULATION 2024 - REG 20
Intestacy involving net estate assets of not more than $2,000
20 Intestacy involving net estate assets of not more than $2,000
(1) This section applies if— (a) a court orders money in court or securities
in court to be paid to a person; and
(b) the person dies before the payment
is made; and
(c) the person’s net estate assets, including the money or
securities, are not more than $2,000; and
(d) the registrar is satisfied the
person died intestate.
(2) The chief executive may pay the money or
securities under the court order to a spouse, child, sibling or parent of the
deceased person who— (a) is entitled to apply for letters of administration
of the deceased person’s estate; and
(b) files an affidavit in the court
stating the facts relied on.
