For section 8 (2) (b) of the Act , an explosive must be classified—
(a) for an explosive to which the UN model regulations apply—(i) according to the explosive’s class, division and compatibility group under the UN model regulations; or(ii) according to the explosive’s class, division and packing group under the UN model regulations; or
(b) for an explosive to which the UN model regulations do not apply—(i) if the explosive is mentioned in the Australian explosives code, appendix 9—as an explosive too dangerous to transport; or(ii) if the explosive is a substance declared to be an explosive under section 6 —as non-dangerous goods.
