46A Requirement for safety and security management system
(1) This section applies to the holder of a prescribed authority if 1 or more
employees of the holder carry out activities under the authority.
(2) The
holder of the authority must have and give effect to a safety and security
management system that complies with subsections (3) and (4) . Penalty—
Maximum penalty—100 penalty units.
(3) For subsection (2) , the safety
and security management system is to relate to— (a) if a place is stated in
the prescribed authority as a place at which an activity may be carried out
under the authority—the place; or Examples of a place for paragraph (a)—
• an explosives factory
• premises where explosives are stored
(b) if
an activity is carried out under the prescribed authority other than at a
place mentioned in paragraph (a) —the activity. Examples of an activity for
paragraph (b)— • blasting activities carried out under a prescribed
authority at various locations
• transporting explosives
(4) The safety
and security management system must include the following— (a) a description
of the holder’s safety and security policy;
(b) details of the
organisational structure of the holder’s operations, including details of
the personnel responsible for performing all the functions provided for under
the system;
(c) a system procedure for each matter stated in schedule 3 ,
part 1 ;
(d) an operational procedure for each matter stated in schedule 3 ,
part 2 that applies to the place or activity to which the system applies;
(e)
a security plan that complies with section 46C ;
(f) an emergency response
plan to manage risk to the safety and health of persons and the security of
explosives in an emergency event;
(g) a process for ongoing consultation with
employees and contractors of the holder who are engaged in carrying out
activities under the prescribed authority, at least once in each month, about
safety and security in relation to the activities.
