ELECTRICAL SAFETY REGULATION 2013 - REG 153
Mark for use in exceptional circumstances
153 Mark for use in exceptional circumstances
(1) The regulator may approve a mark, other than the RCM, for use in
exceptional circumstances.
(2) A person does not commit an offence under
section 145 (1) or 151 in relation to the sale of an item of a type of
in-scope electrical equipment if the item is marked as required by the
approval given under subsection (1) .
(3) Also, a person does not commit an
offence under section 145 (1) or 151 in relation to the sale of an item of a
type of in-scope electrical equipment if— (a) the item is marked with a
mark, other than the RCM, approved under a corresponding law for use in
exceptional circumstances; and
(b) the item is marked as required by that
approval.
