Marina owner levy—Act, s 42
2 Marina owner levy—Act, s 42
(1) The annual levy payable by the owner of a marina under the Act , section
42 (3) is the total of the amounts payable for each berth at the marina worked
out under subsections (2) and (3) .
(2) For subsection (1) , the amount
payable for each berth is— (a) if the berth is not more than 12m in
length—242.25 fee units; or
(b) if the berth is more than 12m but not more
than 18m in length—258.40 fee units; or
(c) if the berth is more than 18m
in length—289.20 fee units.
(3) For the purposes of the
Acts Interpretation Act 1954 , section 48C (3) , the amount is to be rounded
to the nearest multiple of 5 cents (rounding one-half upwards). Example— If
a fee were 35 fee units and the value of a fee unit were $1.015, the number of
dollars obtained by multiplying 35 by $1.015 would be $35.525. Because $35.525
is halfway between $35.50 and $35.55, it is rounded upwards, so the amount of
the fee would be $35.55.
(4) A reference in subsection (2) to the length of
a berth is a reference to its length as at 31 December immediately before the
levy is to be paid.
