23 Who is an agency service provider

(1) A person is an
"agency service provider" if the person enters into a contract with the National Agency to provide goods or services for or on behalf of the National Agency to another person who is not a department of a participating jurisdiction, prescribed authority or the government of a participating jurisdiction.

(2) A person is also an
"agency service provider" if—

(a) the person enters into a contract (the
"subcontract" ) with an agency service provider mentioned in subsection (1) (the
"head contractor" ); and

(b) under the subcontract, the person provides, for or on behalf of the head contractor, the goods or services the head contractor is to provide under a contract mentioned in subsection (1) .
