Limited uses under particular animal authorities
49 Limited uses under particular animal authorities
(1) This section applies to— (a) the holder of an animal authority for an
estuarine crocodile, other than a harvesting licence for estuarine crocodile
eggs; or
(b) a relevant person for the holder.
(2) The holder or relevant
person may only use an estuarine crocodile under the authority to the extent
the use is— (a) breeding the crocodile; or
(b) for a crocodile that has
never attacked a person in the wild—displaying the crocodile; or
(c) for a
crocodile that has never been a problem crocodile—processing the crocodile;
or
(d) for a crocodile that has been a problem crocodile, but is not suitable
for breeding—processing the crocodile; or
(e) selling or giving the
crocodile to another person; or
(f) another use for a purpose other than a
commercial purpose.
(3) However, subsection (2) does not extend the
activities the holder or relevant person may carry out under the authority.
Example— Subsection (2) (c) and (d) does not authorise the holder of an
animal authority mentioned in subsection (1) (a) , or a relevant person for
the holder, to process an estuarine crocodile under the authority if the
holder or relevant person is not otherwise authorised to process the crocodile
under the Act .
(4) For subsection (2) (d) , an estuarine crocodile that
has been a problem crocodile is not suitable for breeding if it is not
possible to breed the crocodile in a way that complies with the Australian
Crocodile Code.
