(1) This section applies in relation to a flying-fox roost management permit for a flying-fox roost considered under section 174 (1) (b) .
(2) The chief executive must not grant the permit unless the chief executive is satisfied—(a) there is, or may be, a threat to a person’s health or wellbeing resulting from harm to the person caused by flying-foxes that congregate at the roost; and(b) action under the permit is unlikely to detrimentally affect the survival of flying-foxes in the wild; and(c) the proposed way of taking action under the permit is humane.
