(1) This section applies if the chief executive is satisfied the reasons for making a temporary marine mammal special management area declaration will still exist after the end of the period stated in the declaration.
(2) The chief executive may extend the period for a further period of not more than 120 days.
(3) Before extending the period under subsection (2) , the chief executive must—(a) publish a notice (an
"extension notice" ) about the proposed extension—(i) in a newspaper likely to be read by people particularly affected by the proposed extension; and(ii) on the department’s website; and(b) have regard to any submissions received under subsection (4) (b) .
(4) The extension notice must state that—(a) consideration is being given to extending the period for which the declaration has effect; and(b) people are invited to make written submissions in relation to the proposed extension within a period of at least 7 days stated in the extension notice.
